1. INTRODUCTION & AGREEMENT

Welcome to UseRecon.com, a website owned and operated by UseRecon.com LLC, a Tennessee limited liability company (“UseRecon.com,” “we,” “us,” or “our”). These Terms & Conditions (“Agreement”) govern your access to and use of the UseRecon.com website and its services.

By accessing or using this website, you agree to be legally bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the website.

You represent that you are at least 18 years old and capable of entering a legally binding agreement.

2. ABOUT US — IMPORTANT ENTITY SEPARATION

UseRecon.com LLC is NOT a real estate brokerage.
UseRecon.com LLC does NOT provide real estate representation, brokerage services, contract assistance, negotiation services, or legal advice.

Affiliated Ownership Disclosure

UseRecon.com LLC is owned by the same individuals who also own RECON Real Estate LLC, a Tennessee-licensed real estate brokerage (“RECON Real Estate”).
The two entities operate entirely separately.

  • UseRecon.com LLC = FSBO advertising platform

  • RECON Real Estate = licensed real estate brokerage

Your use of UseRecon.com does not create any agency, client, fiduciary, or brokerage relationship with RECON Real Estate or any licensed real estate agent.

Hiring RECON Real Estate requires a separate listing agreement, separate fees, and a separate legal relationship.

3. TEMPORARY MLS / REALTRACS DISCLOSURE

UseRecon.com LLC is not a participant in RealTracs or any MLS.

One of the owners (Eddie Hutchinson) temporarily holds a RealTracs participant account in his separate capacity as a licensed real estate broker, only until RECON Real Estate designates a new Principal Broker.

This temporary MLS participation:

  • Does not relate to UseRecon.com LLC

  • Does not convert FSBO listings into MLS listings

  • Does not create a brokerage relationship

UseRecon.com listings are NOT MLS listings and do NOT trigger Clear Cooperation unless and until a separate listing agreement with RECON Real Estate is signed.

4. CLEAR COOPERATION & PUBLIC MARKETING DISCLAIMERS

The Clear Cooperation Policy applies only to brokerage-listed properties.

Because UseRecon.com is an FSBO platform:

  • FSBO listings on UseRecon.com are not MLS listings

  • FSBO listings do not trigger the Clear Cooperation 1-day rule

  • RECON Real Estate agents may not publicly market a FSBO listing unless a listing agreement has been signed

Sellers who choose to later hire RECON Real Estate will be required to sign a new listing agreement, at which point Clear Cooperation rules apply.

5. WHAT USERECON.COM DOES (PLATFORM DESCRIPTION)

UseRecon.com provides:

  • An online advertising space where private owners may list their property for sale or rent

  • Tools that help sellers display photos, descriptions, and contact information

  • Optional paid marketing enhancements (if offered)

UseRecon.com is strictly a publishing and advertising platform for user-generated content.

6. WHAT USERECON.COM DOES NOT DO

UseRecon.com LLC does NOT:

  • Provide legal advice

  • Provide real estate advice

  • Provide brokerage representation

  • Review, draft, or negotiate contracts

  • Verify the accuracy of property information

  • Act as an agent for buyers or sellers

  • List any property in the MLS

  • Market properties as a licensed agent or brokerage

  • Interfere with transaction terms, pricing, or negotiations

Any user needing assistance with contracts, representation, negotiation, disclosures, or due diligence must consult:

  • An attorney,

  • A qualified real estate professional, or

  • A licensed real estate brokerage (including RECON Real Estate if they choose to hire them separately).

7. USER RESPONSIBILITIES & ACCURACY OF INFORMATION

Users are solely responsible for:

  • The accuracy of all property descriptions, photos, pricing, and statements

  • Compliance with Fair Housing laws

  • Compliance with Tennessee real estate advertising rules

  • Ensuring they have authority to advertise the property

  • Updating and correcting listing information

We reserve the right (but not the obligation) to remove any listing for inaccurate, misleading, unlawful, or prohibited content.

8. FAIR HOUSING COMPLIANCE

Users must comply with the Federal Fair Housing Act and all applicable Tennessee fair housing laws.

Discriminatory listings or language are prohibited and will be removed.

9. USER ACCOUNTS & SECURITY

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of unauthorized access.

We are not responsible for losses due to unauthorized account use.

10. THIRD-PARTY CONTENT & INDEMNIFICATION

All listing content is created by users or third-party advertisers, not UseRecon.com.

We do not verify accuracy and do not endorse any statements, offers, or opinions posted by users.

By using the site, you agree to hold UseRecon.com LLC harmless from:

  • Claims related to your listing

  • Disputes between you and other users

  • Your violation of these Terms

  • Your violation of applicable laws

11. PROHIBITED CONTENT & CONDUCT

You may not post or transmit:

  • False, misleading, or deceptive information

  • Infringing or illegal material

  • Harassing, threatening, discriminatory, or obscene content

  • Spam

  • Malware or harmful code

  • Photos of properties you do not own or are not authorized to advertise

  • Photos that are not actual representations of the property

We may remove any content at our discretion.

12. NO WARRANTY — “AS IS” PLATFORM

UseRecon.com is provided “AS IS” and without warranties, including:

  • Accuracy

  • Availability

  • Fitness for a particular purpose

  • Error-free operation

You use the platform at your own risk.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

UseRecon.com LLC and its owners, employees, affiliates, and agents are not liable for:

  • Loss of profits or revenue

  • Loss of data

  • Property damage

  • Inaccurate or misleading listings

  • Unauthorized access to your account

  • Actions of other users

  • Damages arising from use of or inability to use the website

Your sole remedy is to stop using the website.

14. LICENSE TO USE THE WEBSITE

You may view and use the content on the site for personal, noncommercial purposes.

You may not copy, scrape, resell, or commercially exploit the site or its content.

Licensed real estate agents may share listings only to show them to clients, not for marketing unless they have a listing agreement with the seller.

15. DISPUTE RESOLUTION

All disputes will be governed by the laws of the State of Tennessee.

All legal claims must be brought in Montgomery County, Tennessee, in state or federal court.

You agree to this exclusive jurisdiction.

16. MODIFICATIONS TO TERMS

We may modify these Terms at any time. Continued use of the website constitutes acceptance of updated terms.

17. MISCELLANEOUS

  • Failure to enforce any part of this Agreement does not waive our rights.

  • This Agreement constitutes the entire agreement between you and UseRecon.com LLC regarding the site.

  • If any part of this Agreement is found invalid, the remaining terms remain in effect.
